General Provisions, Scope of Services, and Eligibility

1. General Provisions

1.1 Introduction: Welcome to rent-me.app! These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "user," "Host," or "Guest") and rent-me.app ("we," "us," or "our") governing your use of our platform, website, and related services. By accessing or using rent-me.app, you agree to comply with these Terms.

1.2 Definitions: Platform: Refers to rent-me.app, including its website, mobile applications, and services. Host: A user who creates and manages listings to offer their services. Guest: A user who books services through the platform. Listing: Any service, activity, or experience offered by a Host. Member: Any individual who registers and uses the platform, including both Hosts and Guests.

1.3 Entire Agreement: These Terms, along with our Privacy Policy and other policies referenced herein, constitute the entire agreement between you and rent-me.app and supersede any prior agreements.

2. Scope of Services

2.1 Facilitation of Transactions: rent-me.app is a marketplace platform that enables Hosts to list and offer their time, skills, or experiences, and Guests to book these services.

2.2 Independent Relationship: Hosts and Guests act independently, and rent-me.app is not a party to any agreements between them. We do not own, create, control, or manage any Listings or Host services.

2.3 Disclaimer of Responsibility: rent-me.app does not guarantee the quality, legality, suitability, or safety of any Listings or Host services. It is the responsibility of Hosts and Guests to conduct appropriate due diligence before engaging in a transaction.

3. Eligibility

3.1 Age and Capacity: To access and use rent-me.app, you must be at least 18 years old or the legal age of majority in your jurisdiction. By using the platform, you confirm that you have the legal capacity to enter into binding agreements.

3.2 Prohibited Users: You may not use rent-me.app if: You have been suspended or removed from the platform in the past. You are barred by any applicable laws from using such services.

3.3 Legal Compliance: Users are responsible for ensuring their use of the platform complies with all applicable local, provincial, and federal laws, including tax laws and regulations.

Account Registration, Listings, and Content

4. Account Registration

4.1 Creating an Account:

To access certain features of Rentbuddys.com, including creating Listings or booking services, you must register for an account. During registration, you agree to: Provide accurate, current, and complete information. Keep your account information updated at all times.

4.2 Account Confidentiality: You are responsible for maintaining the security and confidentiality of your account credentials. You agree not to share your credentials with third parties or allow others to use your account.

4.3 Unauthorized Access: You must immediately notify us if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from unauthorized use of your account unless it results from our negligence.

4.4 Non-Transferability: Accounts are personal and cannot be transferred or assigned to another party without our prior written consent.

4.5 Termination of Accounts: We reserve the right to suspend or terminate accounts that violate these Terms, involve fraudulent activities, or create risks to the safety or security of the platform or its users.

5. Listings

5.1 Host Responsibilities:

As a Host, you are responsible for:

Creating accurate and detailed Listings, including descriptions, pricing, and availability. Complying with all applicable laws, regulations, and permits related to your services. Ensuring that your Listings do not infringe upon the rights of others or contain false or misleading information.

5.2 Listing Standards: Listings must:

Accurately represent the services offered. Include relevant details, including any restrictions or requirements. Avoid offensive, harmful, or illegal content.

5.3 Prohibited Listings: You may not create Listings that involve:

Illegal activities or substances. Services that violate local, provincial, or federal laws. Content that is discriminatory, offensive, or harmful.

6. Content

6.1 User Content: By posting content on the platform, including text, photos, or other media, you grant rent-me.app a non-exclusive, royalty-free, worldwide, perpetual license to use, modify, display, and distribute such content for the purpose of operating the platform.

6.2 Accuracy of Content: You are solely responsible for ensuring the accuracy, completeness, and legality of any content you post.

6.3 Prohibited Content: You may not post content that:

Contains false, misleading, or defamatory statements. Infringes on intellectual property or privacy rights. Promotes violence, hate speech, or illegal activities.

6.4 Content Removal: We reserve the right to remove or disable access to any content that violates these Terms, applicable laws, or community standards.

Booking Process, Fees, and Payment Policies

7. Booking Process

7.1 Guest Responsibilities: Guests are responsible for:

Reviewing the Listing details, including service descriptions, pricing, and terms, before making a booking. Providing accurate and complete information during the booking process. Ensuring timely payment for the booked services.

7.2 Host Responsibilities: Hosts must:

Respond promptly to booking inquiries or requests. Honor all confirmed bookings as per the agreed terms. Provide the service as described in the Listing.

7.3 Booking Confirmation: A booking is considered confirmed when:

The Guest completes the payment process, and The Host accepts the booking request or confirms the availability of the service.

7.4 Communication: All communication regarding bookings must occur through the platform to ensure transparency and support in case of disputes.

8. Fees and Payment Policies

8.1 Platform Fees: We may charge service fees to both Hosts and Guests for the use of the platform. These fees will be disclosed prior to confirming a booking.

8.2 Payment Processing: Payments are processed through third-party payment providers. By using our platform, you agree to comply with their terms and conditions.

8.3 Host Payouts:

Payouts to Hosts will be processed after the completion of the service, subject to any applicable withholding for disputes or refunds. Hosts are responsible for ensuring their payout details are accurate and up to date.

8.4 Taxes:

Hosts are solely responsible for determining and fulfilling their obligations under local, provincial, or federal tax laws, including reporting income and remitting any required taxes. rent-me.app may withhold taxes or provide documentation to comply with Canadian laws.

8.5 Currency and Exchange Rates: All transactions on the platform are conducted in the specified currency. Guests are responsible for any currency conversion fees or exchange rate differences.

9.1 Cancellation Policies:

Each Listing includes a Host-defined cancellation policy, which Guests must review before booking. Guests and Hosts agree to abide by the applicable cancellation policy when a booking is canceled.

9.2 Guest Cancellations:

Refunds for Guest cancellations will be determined based on the Host’s cancellation policy. Any platform fees may be non-refundable.

9.3 Host Cancellations:

Hosts may only cancel bookings in exceptional circumstances. Frequent or unjustified cancellations may result in penalties, account suspension, or termination.

9.4 Refund Disputes: In the event of a dispute regarding refunds, rent-me.app may mediate and make a final decision at its sole discretion, based on evidence provided by both parties.

9.5 Force Majeure: Refunds or penalties may be waived in cases where cancellations are caused by unforeseen events beyond the control of the Host or Guest (e.g., natural disasters, emergencies).

Reviews, Prohibited Activities, and Liability

10. Reviews and Ratings

10.1 Purpose of Reviews:

The platform allows Guests and Hosts to leave reviews and ratings after a booking is completed. These reviews help provide transparency and build trust within the community.

10.2 Guidelines for Reviews:

Reviews must be honest, accurate, and respectful. Reviews should focus on the booking experience, the service provided, or the Host/Guest behavior.

10.3 Prohibited Content in Reviews: Users may not include:

Defamatory, false, or misleading statements. Offensive, discriminatory, or abusive language. Personal information or private details of other users.

10.4 Moderation of Reviews: rent-me.app reserves the right to moderate, remove, or disable access to reviews that violate these guidelines.

10.5 No Guarantee of Verification: rent-me.app does not verify the accuracy of reviews. All reviews reflect the subjective opinions of the users who post them.

11. Prohibited Activities

11.1 User Obligations: All users must comply with these Terms, community guidelines, and applicable laws when using the platform.

11.2 Prohibited Conduct: Users may not:

Use the platform for illegal, harmful, or fraudulent activities. Circumvent platform systems to avoid fees or conduct direct transactions outside the platform. Post false, misleading, or harmful information. Engage in harassment, discrimination, or abusive behavior. Damage or interfere with the platform’s functionality, including introducing viruses or other malicious code.

11.3 Consequences of Violations:

Engaging in prohibited activities may result in account suspension, termination, and potential legal action.

11.4 Reporting Violations: Users are encouraged to report any violations of these Terms to rent-me.app. We reserve the right to investigate and take appropriate action.

12. Liability

12.1 Platform Responsibility: rent-me.app provides the platform “as is” and “as available.” We do not guarantee uninterrupted service, error-free operation, or the accuracy of Listings or user content.

12.2 No Endorsement: rent-me.app does not endorse any users, Listings, or Host services. Users interact at their own risk.

12.3 Limitation of Liability: To the maximum extent permitted by Canadian law, rent-me.app is not liable for:

Direct, indirect, incidental, or consequential damages arising from the use of the platform. Losses resulting from unauthorized access to accounts. Disputes between Hosts and Guests.

12.4 Indemnification: Users agree to indemnify and hold rent-me.app harmless from any claims, liabilities, damages, or expenses arising out of their use of the platform or violation of these Terms.

Insurance, Privacy, Dispute Resolution, and Governing Law

13. Insurance 13.1 No Insurance Provided by the Platform: rent-me.app does not provide insurance for Hosts, Guests, or any services facilitated through the platform.

13.2 Host Responsibilities: Hosts are solely responsible for obtaining appropriate insurance coverage for the services they offer. This includes, but is not limited to, liability insurance, property insurance, or professional indemnity coverage.

13.3 Guest Responsibilities: Guests acknowledge that rent-me.app does not insure any booked services and agree to consider their own insurance needs, including travel, accident, or liability coverage, where applicable.

13.4 Third-Party Insurance Requirements: Hosts and Guests agree to comply with any third-party insurance terms that may apply, such as requirements imposed by landlords, associations, or local authorities.

14. Privacy

14.1 Data Collection and Use: rent-me.app collects, uses, and stores personal information in accordance with our Privacy Policy, which complies with Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA).

14.2 User Consent: By using the platform, you consent to the collection, use, and sharing of your personal information as described in our Privacy Policy.

14.3 User Responsibilities: Users are responsible for protecting their own privacy by ensuring secure communication and avoiding sharing sensitive personal information with other Members unless necessary for a booking.

14.4 Data Protection: rent-me.app employs reasonable measures to protect user data but does not guarantee absolute security against unauthorized access, breaches, or loss of data.

15. Dispute Resolution

15.1 Initial Resolution: Users are encouraged to resolve disputes directly between themselves. If resolution cannot be reached, rent-me.app may, at its discretion, assist as a mediator.

15.2 Formal Complaints: Disputes not resolved informally must be submitted in writing to rent-me.app for review. The platform will assess the matter and may make a binding decision to resolve the issue.

15.3 Arbitration Agreement:

Any disputes arising from these Terms or use of the platform will be resolved through binding arbitration in accordance with the laws of the province or territory where rent-me.app operates. Arbitration will be conducted in English and in the jurisdiction determined by rent-me.app.

15.4 Exclusions: This arbitration agreement does not apply to claims for injunctive or equitable relief related to intellectual property rights, which may be pursued in a court of competent jurisdiction.

16. Governing Law

16.1 Applicable Laws: These Terms are governed by the laws of Canada and the province in whichrent-me.app is registered, without regard to conflict of law principles.

16.2 Legal Compliance: Users agree to comply with all local, provincial, and federal laws applicable to their use of the platform.

16.3 Jurisdiction: Any legal action or proceeding arising under these Terms will be subject to the exclusive jurisdiction of the courts in the province where rent-me.app is registered.

Final Provisions and Miscellaneous

17. Force Majeure

17.1 Definition: rent-me.app is not liable for delays or failure to perform resulting from events beyond its reasonable control, including but not limited to:

Natural disasters (e.g., floods, earthquakes, storms). Acts of war, terrorism, or civil unrest. Government actions or changes in laws. Internet or telecommunications outages.

17.2 Exclusions: While such events may prevent the platform from operating as expected, this does not relieve Hosts or Guests of their obligations under existing bookings unless explicitly waived by rent-me.app.

18. Severability

18.1 Invalid Provisions: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

18.2 Amendment of Invalid Provisions: If a provision is deemed invalid, rent-me.app will replace it with a valid provision that closely approximates the original intent and economic effect.

19. Entire Agreement

19.1 Integration of Terms: These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and rent-me.app concerning your use of the platform.

19.2 Supersession: These Terms supersede and replace any prior agreements, discussions, or understandings between you and rent-me.app related to the subject matter herein.

20. Waiver

20.1 No Waiver: rent-me.app's failure to enforce any provision of these Terms will not constitute a waiver of its rights to enforce that or any other provision.

20.2 Specific Waivers: Any waiver granted by rent-me.app must be in writing to be valid and will apply only to the specific instance for which it is granted.
